The videmic app is an offer of videmic GmbH, Potsdamer Straße 96, 10875 Berlin (hereinafter: videmic). videmic takes the protection of your data very seriously. The collection and processing of your data is therefore always based on the current regulations of the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act. Your data will be stored on servers in Germany on the basis of an agreement on proper data processing within the meaning of Art. 28 GDPR.

Below videmic informs you in detail about the usage of your data. This privacy policy and our terms of service can be accessed and viewed at any time in the videmic app and on the website. videmic reserves the right to adjust this privacy policy to comply with applicable data protection regulations in order to ensure legally secure usage of your data.

1. General Information

videmic offers you the videmic app on the platforms “Google Play” and “Apple App Store”. In addition, the data protection regulations of the platforms “Google Play” apply to our app, and “Apple App Store”

1.2 Purpose of Data Collection, Processing and Usage

videmic stores your data only to provide our offer, especially our app and to answer your questions.

1.3 Privacy of young people under 16 years of age

Young people under the age of 16 are not allowed to use the videmic app. videmic therefore deliberately does not request or collect any information from young people under the age of 16. If we have collected personal information from a young person under the age of 16 without our knowledge, we will delete this data immediately upon receiving notification to this effect.

1.4 Your rights (so-called rights of affected persons) and the Respective Legal Principles

You have the right:

a) to request information about the purpose of processing, the categories of data processed, any recipients and the planned duration of the storage of your data (so-called right to information; Art. 15 GDPR).

b) to demand the correction of incorrect data concerning you and the completion of incomplete personal data (so-called right of correction; Art. 16 GDPR).

c) to revoke your consent to data processing at any time (so-called right of revocation; Art. 7 para. 3 GDPR)

d) to object at any time to any data processing concerning you for reasons arising from a particular situation (so-called right of objection, Art. 21 GDPR)

e) that videmic deletes personal data concerning you immediately (so-called right of deletion or forgetting, Art. 17 GDPR) if

(1) your information is no longer necessary for the purposes for which it was collected
(2) you have withdrawn your consent (cf. b);
(3) you have objected to further processing (cf. c);
(4) your personal data have been processed unlawfully.

f) to demand the restriction of the processing, e.g. if you dispute the accuracy of the personal data, you refuse to delete your data, you still need your data or you have objected to the data processing and the examination of the objection is still ongoing (so-called right of restriction, Art. 18 GDPR)

g) to receive the data concerning you which you have provided to videmic in a structured form and, if necessary, to have it transmitted to third parties (so-called right to data transferability, Art. 20 GDPR)

h) to complain to the competent supervisory authority about data processing (so-called right of appeal, Art. 77 GDPR). The supervisory authority responsible for videmic is the Berlin Commissioner for Data Protection and Freedom of Information, Friedrichstraße 219, 10969 Berlin. Alternatively, you can contact the data protection authority responsible for your place of residence.

To exercise one of these rights, send a request to the contact details mentioned in section 1.1, and identify you clearly and unambiguously.

2. Data Collection by videmic

The videmic app collects and stores only your chosen nickname and the titles of your videos in the videmic app on your mobile device. These data are necessary to be able to transmit your videos to the desired users and serve the fulfilment of the contractual relationship in terms of Art. 6 Abs. 1 S. 1 lit. b GDPR.

The videmic app also transmits anonymous and statistical usage data to videmic for the purpose of providing, improving and further developing the videmic app and for measuring the effectiveness and reach of marketing measures. Pursuant to Art. 6 para. 1 sentence 1 f GDPR, the evaluation serves to safeguard our legitimate interests in the proper functioning of our app.

Device-specific information such as the version of the operating system is stored. Furthermore, videmic collects data on individual usage processes in a database. These collected data are collected anonymously and on a list basis and cannot be assigned to a specific person. That’s why we don’t know who you are.

videmic operates a video database server to store the videos published in the videmic app and make them available for download to all users at any location. In addition, this database also collects anonymized user statistics (see above). The data records contain, for example, data on how often a video of a channel was viewed in a given time period, how many videos of a channel were viewed by an anonymized user in a given time period, or how many friendship relationships an anonymized user has established in a given time period.

Viewing certain videos or subscribing to certain channels via the videmic app results in an anonymous user profile. Based on this user profile, videmic will suggest videos from other users or from the videmic video database for download. The evaluation of anonymous user profiles serves in accordance with Art. 6 Par. 1 S. 1 lit. f GDPR to protect our legitimate interests in optimizing our offer, which outweigh our interests.

Information about the mobile network, telephone numbers, information about visited websites and location information (e.g. GPS data) is not recorded and transmitted to videmic. The data processing takes place solely in Germany on servers of videmic GmbH. Data will not be transferred abroad.

3. Location-Based Contact Tracing

You have the option to enable location-based contact tracing in the videmic app.

3.1 Information from users that are stored

If you have enabled this functionality, the videmic app stores the following information: Your stays of at least 5 minutes within range of a videmic appliance operated by a videmic partner, the nickname of the corresponding videmic appliance, the date and the exact duration of the stay. Typically, the location of the videmic appliance is chosen as the nickname. This information is only stored locally on your device. This information is not shared with videmic or any third party. After 14 days, the stored information is automatically deleted.

3.2 Transmission of anonymous information to other users

If a user of the videmic app is found to be infected with the corona virus, this user can make an anonymous report via the app. To hamper misuse, this anonymous report requires the validation by a code. If you make such a report, the information listed in 3.1 is anonymously transmitted to the other users of the app, namely to the device on which the app is installed. On this device a comparison with the stays of these users stored there will then take place. If the comparison shows that one or more stays match with regard to time and place (i.e. nickname of a videmic appliance), the respective user will be informed of this fact in the videmic app. However, the user will not be informed about which time or place the match refers to.

3.3 Information from a videmic appliance that are stored

If you operate a videmic appliance as a videmic partner and have activated contact tracing, the nickname you have associated with the appliance will be transmitted to other users, who are within the range of the appliance for more than 5 minutes. This information is stored on their mobile devices together with the date and the exact duration of their stay for 14 days and can be viewed by the respective user.

4. Dissemination of Personal Data

Certain data such as your chosen nickname and the titles of your videos will also be transferred to other users of the videmic app in the videmic app according to your chosen settings. This information is necessary for the proper functioning of the videmic app and thus for the provision of our services within the meaning of Art. 6 Para. 1 S. 1 lit. b GDPR.

Furthermore, your data will be passed on to third parties if videmic is obliged to do so by law or by an enforceable official or court order pursuant to Art. 6 para. 1 sentence 1 d GDPR. videmic will not transmit any data records to advertising partners.

5. App Analytics Services

a) Flurry
videmic uses the mobile app analytics service “Flurry”. Flurry is a service of Oath Inc., 701 First Avenue, Sunnyvale, CA 94089, USA.

The statistical data collected by the analytics service Flurry helps us to understand how the videmic app is accepted by users and serves to continuously improve our service. Pursuant to Art. 6 para. 1 sentence 1 f GDPR, the evaluation serves to safeguard videmic’s overriding legitimate interests in the further development of the videmic app within the scope of a weighing of interests.

Flurry does not collect personal information such as your phone number or your smartphone serial number (UDID). Flurry only stores general usage data such as the device type, the operating system used, the name of the provider and user and access numbers.

b) AppsFlyer
videmic uses the mobile app analytics service “AppsFlyer”. AppsFlyer is a service of AppsFlyer Ltd, Maskit St. 14, Hertsliya, Israel.

The AppsFlyer service measures the success of mobile advertising campaigns by measuring the effectiveness of app install campaigns. Pursuant to Art. 6 para. 1 sentence 1 f GDPR, the evaluation serves to safeguard videmic’s overriding legitimate interests in the further development of the app videmic within the scope of a weighing of interests. 6. Digital Rights Management

videmic utilizes the digital rights management (DRM) software widevine. widevine is a service of Widevine Technologies, 747 6th Street South Kirkland, WA 98033, USA, a subsidiary of Google LLC., 1600 Amphtheatre Parkway, Mountain View, CA 94043, USA.

videmic uses widevine to allow operators of channels with particularly high-quality video content (so-called premium channels) to publish their videos for a limited period of time and to offer operators effective protection against unauthorized duplication of their videos outside the videmic app. videmic will specially identify premium channels. The contents of the premium channels are always encrypted and can only be viewed if your authorization has been checked using widevine. The legal basis for the processing of personal data described here is Art. 6 para. 1 lit. f) GDPR.

As soon as you click on a video of a premium channel, your UDID (serial number of your smartphone) and your current IP address are transmitted to widevine. widevine thus learns that you want to watch the video. If you are authorized to view the corresponding content, widevine will enable the video to be played. It cannot be excluded that widevine also transfers the information to a server in a third country. widevine is a service of Google LLC. According to, Google LLC has a Privacy Shield certification (can be found at under the search term “Google”). Accordingly, Google LLC has committed to comply with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework for the collection, use and storage of personal data from the member states of the EU and Switzerland. Google has declared through certification that it complies with the Privacy Shield Principles.

If you want to prevent data processing by widevine, do not subscribe to any channel that videmic has marked as a premium channel.

7. Duration of Storage

videmic stores your data only as long as this is necessary for the provision of our services or there is a legitimate interest in the further storage, which exceeds your interest in a deletion. In addition, videmic stores data as long as it is required to fulfill contractual obligations and legal storage periods.

If you wish to object to the collection, processing and use of your data by videmic for the future as a whole or for individual measures, you can send your objection by e-mail, fax, or letter to the following contact details:
